All citizens have the freedom of conscience. The criminal accused is presumed to be innocent until proven guilty. The President grants medals and other honors as prescribed by law. The organization and operation of the Constitutional Court, and other necessary matters shall be determined by law. Ordering a pardon requires the consent of the National Assembly. The President cannot request a retrial or amendment of some of the bills. The bill takes effect by law even if the President does not request enactment or retrial within the period specified in paragraph 1. The Constitutional Court may establish rules on trial procedures, internal rules, and administrative procedures to the extent that it does not violate the law. The state can regulate and adjust the economy to maintain balanced growth and stability of the national economy, rational distribution of income, prevent market dominance and abuse of economic power, and achieve economic democratization through harmony among economic actors.
The chairman of the National Security Council (NSC) is the president. All citizens have the right to live in a healthy and pleasant environment, and the state and its people must strive to protect the environment. Public officials are volunteers for all citizens and take responsibility for the people. The President is responsible for protecting national independence, territorial integrity, national continuity, and the Constitution. The state should establish and implement a plan necessary for the comprehensive development and support of rural and fishing villages to protect and foster agriculture and fisheries. Workers have the right to organize independently, negotiate as a group, and act as a group to improve working conditions. The establishment, organizational structure, and scope of responsibility of each administrative department are determined by law. Independence, professionalism, political neutrality, and autonomy of universities are guaranteed by law.
The period of the regular meeting is not more than 100 days, and the period of the extraordinary meeting is not more than 30 days. Members of the National Assembly may not abuse their authority to acquire property rights, interests, or status through contracts or dispositions with the state, public institutions, and enterprises, or to broker the acquisition of property rights, interests, or status of others. The status and manners of former presidents are determined by law. The President is elected by the people through ordinary, equal, direct, and secret elections. The President leads the Armed Forces in accordance with the provisions of the Constitution and laws. All citizens have the right to live in a healthy and pleasant environment, and the state and its people must strive to protect the environment. The President shall immediately disclose the reasons under paragraphs 3 and 4.
No citizen can be tortured, nor can he be forced to speak against him on criminal matters. Marriage and family life must be established and maintained on the basis of individual dignity and gender equality, and the state guarantees it. All citizens enjoy dignity and values as human beings and have the right to pursue happiness. The state has a duty to ensure and protect individuals’ basic human rights from being violated. All freedoms and rights of the people can be limited by law only when necessary for national security, maintenance of order, and public welfare, and even if limited, the essential content of freedom and rights cannot be violated. No one can be arrested or detained without notification of the reason for arrest or detention and the right to receive assistance from a lawyer. The reason, time and place for arrest or detention must be immediately notified to the person prescribed by law, such as the family of the person arrested or detained.
Members of Parliament may not abuse their power to acquire property rights, interests or status through contracts or orders with the state, public agencies and companies, or to mediate the acquisition of property rights, interests or status by others. Matters such as pardon, commutation of sentence, and restoration to the original status quo are all regulated by law. All citizens have the right to live a humane life. If ongoing spending is required for more than a financial year, the government must set deadlines and obtain parliamentary approval for continued spending. If property rights and compensation are accepted, used or restricted due to public needs, they must be implemented in accordance with the law and full compensation must be provided. Political parties are protected by the state in accordance with the law, and the state can provide the resources required for the operation of political parties in accordance with the law.
The total amount of the reserve must be approved by Congress. Reserve spending must be approved by the next Congress. If an objection is raised to a bill, the President may transmit the objection in writing to Congress and request reconsideration within the time specified in paragraph (1). The same goes for when Congress is not in session. I solemnly swear to the people that I will faithfully perform my duties as president, uphold the Constitution, defend the motherland, strive for the peaceful reunification of the motherland, promote people’s freedom and welfare, and develop national culture. By regulating and controlling the economy, the state can maintain the stability and full balance of national economic growth and income distribution, prevent market dominance and abuse of economic power, and achieve economic democratization through harmony among economic actors.
The President shall promptly disclose the reasons set forth in paragraphs 3 and 4. The state religion is not recognized and church and state are separated. The freedoms and rights of the people shall not be infringed upon for reasons not enumerated in the Constitution. The president cannot request reconsideration or amendment of certain bills.
